The following case studies have been anonymised to protect the people and organisations involved.

The matter has progressed into formal dispute resolution through the Victorian Equal Opportunity and Human Rights Commission and an employment process before the Fair Work Commission. I continue to support the worker through conciliation while the matter remains ongoing.

The investigation preserved important evidence and established a clear trail concerning the adjustment requests, employer knowledge, escalating psychosocial distress, timing of the employment decision and inconsistencies within the records later produced.

It also ensured that the matter was considered across the connected areas of disability adjustment, psychological health and safety, employment records and general protections, rather than being treated only as a straightforward resignation. No final findings or outcome have been reached.

THE ISSUE

THE OUTCOME

I reconstructed the complete chronology using contemporaneous emails, messages, adjustment requests, photographs, HR documents, payroll records and witness information.

I examined what management knew, when concerns were raised, which adjustments were proposed, how the organisation responded and how quickly the employment cessation was processed.

The investigation identified significant record gaps. No contemporaneous incident report, adjustment assessment, welfare record, EAP referral, exit interview record, manager’s file note or relevant internal HR communications had been produced.

I also identified inconsistencies in the unsigned cessation document and later correspondence, including questions about when records were created, amended or entered into the HR system.

I developed a detailed chronology, evidence and witness matrices, a records inconsistency register, preservation requests and targeted requests for HR-system audit histories, document metadata, internal communications and CCTV.

The matter was analysed across disability adjustments, psychosocial safety, discrimination, employment records, dismissal, adverse action and general protections.

A worker with a disclosed disability had repeatedly raised concerns about a noisy, interruption-heavy working environment and proposed practical workplace adjustments. Following acute workplace distress, the employment ended in circumstances later characterised by the employer as a verbal resignation.

Important HR, adjustment, incident and exit records were incomplete, inconsistent or unavailable.

The circumstances also raised broader concerns about the organisation’s management of psychosocial hazards and its systems for preventing psychological harm.

Key Learning

Disability adjustments, psychosocial distress and employment decisions must be managed together. Structured consultation, a welfare response and accurate records can prevent rushed decisions and significant organisational risk.
